Reassessing Infrastructure Accountability in Ghana

The Ministry of Roads and Highways in Ghana is moving toward a major policy shift regarding public infrastructure delivery. Authorities have signaled that the traditional one-year defect liability period mandated for civil engineering contractors and consultants is no longer sufficient to guarantee long-term asset integrity across the country.

Speaking on infrastructure quality control, sector leaders highlighted the recurring financial burden placed on the national budget when newly constructed or rehabilitated Ghana roads deteriorate prematurely within months of commissioning. The proposed regulatory review aims to enforce stricter performance benchmarks across all regional and trunk road projects.

The Shortcomings of the One-Year Rule

Under current procurement and construction frameworks, contractors are legally bound to repair structural failures, surface cracking, and drainage issues for a period of 12 months following project hand-over. However, industry stakeholders note that this timeframe often expires before the onset of extreme weather patterns, particularly heavy seasonal rainfall cycles that expose substandard sub-base preparation and poor asphalt compaction.

By extending the accountability window, the government intends to compel civil engineering firms and supervising consultants to utilize higher-grade materials and adhere strictly to engineering specifications. This policy direction aligns with broader efforts to maximize value for money in public investments and protect taxpayers from funding recurring rehabilitation works.

Implications for Local and International Contractors

The impending review of contract terms is expected to reshape how engineering firms bid for public works in West Africa’s second-largest economy. Construction companies operating within the sector will need to implement more rigorous internal quality assurance protocols and secure extended performance bonds.

  • Enhanced Quality Control: Stricter oversight on sub-base stabilization and bitumen standards.
  • Extended Financial Guarantees: Potential increases in retention monies held by the state during the extended liability phase.
  • Consultant Accountability: Increased liability for supervising engineering firms that sign off on substandard construction milestones.

As the Ministry finalizes consultations with the Association of Road Contractors and professional engineering bodies, the public anticipates that these regulatory reforms will finally deliver durable, all-weather transportation networks capable of supporting sustainable economic growth and regional trade.
